TERMS AND CONDITIONS OF SALE AND USE

Purpose and scope

These General Terms govern access to the site, orders for products and the services offered by Jouvence Care, including, where available, the “La Cure” service putting users in contact with independent professionals. They apply to consumers and, where relevant, to business customers, subject to the mandatory provisions specific to their status and country.

Age and capacity

Orders intended for individuals are reserved for people who are legally capable of contracting and of full age. Jouvence Care may apply a higher age limit where this is required by the legislation of the territory or by the nature of a service.

Products and territorial availability

Essential characteristics and prices are shown on the relevant pages. The presence of a product on the site does not mean that it may be sold or shipped in every country. Jouvence Care may limit or suspend its availability depending on regulations, import/export rules, customs or logistical constraints. Certain products may carry the wording “Research Only” or equivalent. That wording must be understood in accordance with the labelling and applicable rules and does not by itself constitute an authorisation for medical, therapeutic or human use.

Ordering

The customer selects the products or services required, checks their basket, provides the necessary information and confirms the order after having read these General Terms. The order becomes final in accordance with the process shown at checkout and after confirmation of payment, subject to the applicable security, availability and regulatory compliance checks. Jouvence Care may refuse or cancel an order on legitimate grounds, in particular suspected fraud, unavailability, obvious error, impossibility of delivery or regulatory restriction. Sums due in respect of an order that has been paid for but not fulfilled are then refunded in accordance with the applicable rules.

Prices, taxes and invoicing

The applicable prices are those displayed at the time of the order, in the currency indicated. Applicable taxes are handled in accordance with the regulations and the information presented at checkout. For certain shipments outside the EU, customs duties, import taxes or local charges may be claimed from the recipient, except where their inclusion is expressly stated.

Payment

The payment methods offered may include bank card, Apple Pay, Google Pay or transfer, depending on the options available at checkout. Electronic payments may be facilitated by Frame, and the associated banking flows may involve Wise depending on the operational configuration. Jouvence Care does not ask customers to send their full banking details by e-mail. An order may be suspended in the event of payment failure, rejection or anomaly.

Preparation and delivery

The usual preparation time is 24 to 48 working hours, subject to availability and any necessary checks. Orders may be dispatched from France and, for certain orders intended for the Brazilian market, from local stock in Brazil. Jouvence Care may use Chronopost for France and certain European destinations, DHL for certain international destinations and local solutions for Brazil. The actual carrier may vary with the destination and operational constraints.

Free delivery

Standard delivery may be free from €250, depending on the territories and conditions displayed at checkout. Certain express options or particular destinations may be excluded from this offer where clearly stated.

Risk, loss and damage

For sales to consumers, the mandatory rules on the transfer of risk continue to apply. In the event of a parcel confirmed as lost or a product damaged in transit, Jouvence Care reviews the case and offers, depending on the circumstances and applicable rights, a reshipment, a replacement or a refund. The customer is asked to keep the packaging and provide the information reasonably useful for handling the incident.

Right of withdrawal

Where the applicable legislation confers on the consumer a right of withdrawal for a distance sale, they may exercise it within the statutory period and without having to justify their decision. The practical arrangements and the model form are made available by Jouvence Care. The statutory exceptions to the right of withdrawal continue to apply, in particular, where their conditions are met, for certain sealed goods that cannot be returned for reasons of health protection or hygiene once unsealed. That exception does not affect the statutory guarantees in the event of a defect or lack of conformity.

Returns, exchanges and refunds

Eligible products returned under the commercial policy must be intact, unused, unopened and, where a seal exists, with that seal unbroken. Jouvence Care covers the return costs of eligible returns accepted in accordance with the arrangements communicated by its customer service. Detailed rules are set out on the “Returns / Exchanges” and “Refund Policy” pages. The customer's mandatory guarantees and rights prevail over any less favourable commercial provision.

Statutory guarantees

Consumers benefit from the applicable statutory guarantees, in particular those relating to conformity and latent defects where French law applies. No clause of these General Terms is intended to reduce or exclude a mandatory legal right.

La Cure — introductions

La Cure makes it possible, among other things, to facilitate the booking of appointments and contact with doctors, nutritionists, coaches or other independent professionals. Jouvence Care may carry out certain administrative or technical functions, including booking and, where provided for, facilitating payment. Unless stated otherwise, the professionals are not employees of Jouvence Care and retain their autonomy. Jouvence Care does not make medical diagnoses and does not issue medical prescriptions. Each professional remains responsible for their own service and professional obligations within the limits set by law.

Independence between La Cure and product sales

Being put in contact with a professional is separate from the product sales business. An independent professional is under no obligation to recommend a Jouvence Care product and must retain their professional judgement. Booking a consultation guarantees no result and does not imply that a product is appropriate or available for the customer.

Personal data

Personal data is processed in accordance with the Privacy Policy. Jouvence Care limits the information processed within La Cure to what is necessary. Where information relating to health must actually be processed, the applicable enhanced requirements must be observed. Health data or questionnaires intended for professionals must not be deliberately sent to advertising tools such as the Meta Pixel.

Cookies and marketing

Trackers that are not strictly necessary and are subject to consent, in particular the Meta Pixel where it is used for Facebook/Instagram, must be managed in accordance with the user's choices and the Cookie Policy. Signing up for marketing communications must remain separate from acceptance of these General Terms where the regulations require it.

Customer reviews and content

Reviews or testimonials published are not a guarantee of results. Jouvence Care may moderate content that is manifestly unlawful, fraudulent, abusive or unrelated to the service, without artificially altering the overall presentation of reviews. Scientific or educational content on the site does not constitute a diagnosis or a personalised prescription.

Liability

Jouvence Care answers for its obligations within the limits set by law. It cannot be held liable for damage resulting exclusively from use contrary to clearly communicated instructions, restrictions or warnings, subject to liabilities that cannot lawfully be excluded. As regards the independent professionals of La Cure, Jouvence Care's involvement as an intermediary does not automatically transfer to Jouvence Care responsibility for acts or decisions falling within the professional's own competence.

Intellectual property

The trade marks, logos, visual identity, texts, photographs, creations, content and elements of the site are protected by the intellectual property rights of Jouvence Care or of their owners. Any unauthorised reproduction or exploitation is prohibited within the limits set by law.

Force majeure

Neither party may be held liable for a failure resulting from an event meeting the legal criteria of force majeure, subject to the obligations that remain applicable and to mandatory consumer rights.

Complaints and mediation

Any complaint may be addressed to hello@jouvencecare.com. For the consumers concerned, after a prior written complaint has remained without a satisfactory solution, free recourse to a consumer ombudsman may be exercised in accordance with the applicable rules. The contact details of the ombudsman engaged by Jouvence Care are to be inserted here once membership is finalised.

Governing law and disputes

These General Terms are governed by French law, without depriving a consumer of the mandatory protective provisions of their country of residence where these are applicable. Mandatory rules of jurisdiction, in particular those protecting consumers, prevail over any provision to the contrary.

Amendments to the General Terms

Jouvence Care may amend these General Terms to take account of changes in its services, its providers or the regulations. The version applicable to an order is the one accepted at the time the order is placed, unless the law provides otherwise.
